The Media can be misleading.

Yeah I know, no surprise there!

But let's talk about HR 3221, H.R. 3221 or if you want to call it by it's really long name, the Housing and Economic Recovery Act of 2008

It was signed into law Monday July 28th, 2008. It was reported all over the world. it's the talk of the town. I've been interviewed on radio shows, quoted in articles and blogs. Ok, now what?

Just about nothing. We're waiting.
There's quite a few facets included in the bill that still need to be hashed out. Here's a quick peek at just some of the facts.

 


The $7,500 Tax Credit

It's a tax credit (not a rebate). It's for purchases made between April 9, 2008 and July 1, 2009. It's essentially an interest free loan for 5 years that has to be paid back.

Down Payment Assistance Programs

HR 3221 wipes out the ability for down payment assistance on an FHA loan starting October 1, 2008. Think you have till then? Think again. The Lenders are already not allowing DPA on the loans they are accepting.

Skin in the game

FHA used to finance up to 97%. That meant that the buyer had to pony up the other 3%. As of October 1st, under the new rules, the borrower will have to 3.5%.

Reserve Requirements for Second Homes

Thinking about buying a second home? Vacation home? How about Rental Property. It's a great time to find bargains. How much liquid reserves do you have in the bank? There wasn't a minimum reserve requirement before. Now there is.

Have less than 30 % equity in the second home? You'll need to prove you also have 6 months worth of PITI reserves for both properties in the bank (liquid). Yeah I said SIX months! Have more than 30%? You'll just need to prove you have two months reserves.

Capital Gains Exclusion

Are you good at percentages? Remember when you were entitled to $250,000/$500,000 of tax-free gains from the sale of a home if filing separately/jointly provided you lived in the residence for at least 2 of the preceding 5 calendar years? Not any more.

Now that exclusion is calculated by taking the capital gains on the sale of the home and multiplying it by a ratio (percentage) of how long you lived in the home and how long you owned the home.

Loan Limits Increased!

Nope. Matter of fact, depending on where you live, FHA, Fannie and Freddie Conforming Jumbo loans will decrease.

The Mandatory Refinance at 90% of Present Value

I saved the best for last. First of all it's not mandatory. It's actually voluntary on the lenders part. Should a lender decide this is in their best interest, they'll still hold the note. They'll reduce the size of that note to 90% of the present value and that's what FHA will be on the hook for. Then again, nothing here is in concrete. The details still have to be hammered out by HUD. Until that happens, nothing really has changed.

So there you go. You know know more about HR 3221 than the next guy at the water cooler.

These models will be built at the Trailside Subdivision at Hafen Lane and Grapevine Rd.  Trailside is right by the Charles Hughes Middle School and is close to several parks, tennis courts, and one of my favorite Mesquite Nevada Walking Trails by the river.

  After the lots that are left in Trailside are sold, the homes can be built on other locations in Mesquite.

Sounds like Ence Homes will be giving Sun City Mesquite some competition!

First time buyer credit - Mesquite NV - Housing Bill provides a $7500 tax credit

First Time Buyers in Mesquite NV - Housing Bill provides a $7500 tax credit for First Time Home Buyers.  (Not a Grant) If you are deciding whether or not to buy a home in Mesquite Nv now, or wait a bit longer, you might want to look at this excellent article written by Richard Smith.  Richard Smith is an experienced lender who provides loans in Tennessee, Georgia and Alabama.  He has graciously given me permission to use his article.

The first step in buying a home is to pre-qualify with a lender.  Call me if you would like to talk to a local lender to find out what loan you will qualify for.

Then you might want to search Mesquite NV MLS to see what your money will buy.

If you haven't owned a home in the last 3 years, you may qualify for this 7500 First Time Buyer credit.

The $7500 tax credit for first time home buyers is a significant incentive to purchase. It is a major image of dollar signpositive provision in the Housing Bill that passed Congress over this past weekend. This is a credit not a deduction, which means it directly reduces the taxes owed - dollar for dollar.

This gives the new home owner directly as much as $7500 cash in the pocket at tax refund time.

The credit incentive is retroactive back to April 9, 2008 and continues through June 30, 2009. The incentive is 10% of the purchase price up to a maximum of $7500.

The actual legislation that implements this tax incentive is called the Housing Assistance Tax Act of 2008 HR 5720. It is included as part of the massive Housing Bill HR 3221, that is waiting to be signed into law.

The incentive is available to individuals who make less than $75,000 and to couples who make less than $150,000. Above these income levels the incentive is reduced and is completely phased out at $95,000 for an individual and $170,000 for a couple.

The tax credit must be repaid over the next 15 years, and more quickly if the home is sold or is no longer the primary residence. Repayment is made by increasing the tax owed in the year the home status is changed (sold or no longer the primary residence). A first time home buyer is defined as not having an ownership interest in a principal residence in the previous 3 years.

This credit can be good news for many first time buyers. Some reports indicate that over 2 million first time home buyers last year, and a large percentage of them would have qualified for such an incentive it had been offered last year.

It may offset some of the less good news for home buyers in the Housing Bill with the loss of seller funded down payment assistance

Mesquite Real Estate Market - The Eye of the Hurricane

Is the Mesquite real estate market finally in the eye of the hurricane?

When a hurricane warning becomes known, decisions need to be made to protect your family, your property and your possessions.  Do you flee the area, leaving behind everything that you have built and worked for?

Or did you hunker down and prepare to wait it out and come back strong to rebuild with what is left?

home on stilts ready for the floodMost of us underestimated the strength and fury of the hurricane that hit the real estate market in Mesquite NV and most areas of the country.

The huge loan tornado grew bigger and bigger and devastated all in it’s path of fury.  The fuel price tornado gained force and impacted all aspects of business in the country.

Gretchen Faber called it the perfect storm in her post Riding Out the Storm.

As we are waiting for the eye of the hurricane to pass over, we can assess the damage and prepare for the aftermath of flooding that is already here and the smaller tornadoes that are still to come.

Too many homeowners have not been able to save their homes.  Many real estate related companies were not able to prepare and have had to flee the storm.

Some families will lose everything.

Blue sky in a Mesquite NV StormSome homeowners cannot afford to sell their homes right now.  They owe more than they paid for their home before the storm.


But many sellers here have been able to adjust their price and hunkered down to be in prime position when the hurricane passes and the pent-up buyers leave their basements.

We are finally seeing some patches of  blue sky - you have to look hard between the dark clouds.

The 'easy to qualify for' loans are gone with the wind - Only buyers with good credit and some cash for down payment are in a position to buy.

As these pent up buyers make their moves, the flood of homes on the market will eventually subside.  And the market will stabilize.

The prices will eventually start going up.  But pay attention - when that patch of blue peeks out of the gray sky - don't be the last one to climb out of the basement.
